These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. All sales of Products are governed by our Shipping/Returns Policy. By purchasing Products from mymexicancandy.com, you agree to our Shipping/Returns Policy.
JURISDICTION
This Site is operated by Mexican Candy Online Ca from its offices in Chula Vista, California. This Agreement shall be construed in accordance with the laws of the State of California, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts of the State of California, County of San Diego.
ONLINE PAYMENTS TERMS AND CONDITIONS
Please read these terms carefully before using the online payments facility. Using the online payments facility on this website indicates that you accept these terms. If you do not accept these terms do not use this facility.
These terms and conditions apply to all online payments made to Mexican Candy Online Ca
All payments are subject to the following conditions:
Your payment will take a minimum of 2 working days to reach your account. (This includes time to verify your credit/debit card details with your credit/debit card supplier and for payment to be notified to mymexicandy.com) If your payment is overdue and recovery action is about to be taken, you should contact the relevant department.
We cannot accept liability for a payment not reaching the intended account due to a customer quoting an incorrect account number.
Neither can we accept liability if payment is refused or declined by the credit/debit card supplier (due to the customer quoting incorrect card details or other reasons).
If the credit/debit card supplier declines payment, Mexican Candy Online Ca’s, is under no obligation to bring this fact to the customer's attention. Customers should check with their bank/credit/debit card supplier that payment has been deducted from their account.
REFUND POLICY
RETURN POLICY:
MyMexicanCandy.com does NOT accept returns of any edible products. All return/refund requests must be made to our Customer Care department within 10 business days of receipt of your order AND must be authorized by customer service in advance. To protect our customers’ health and safety, MyMexicanCandy.com only accepts returns of non-edible items that have not been worn or used (apparel, accessories, etc.). Refunds for returns exclude shipping costs, and the customer is responsible for shipping the products back to us in their original condition at their expense. A 10% restocking fee will be applied to returns of non-edible products. A 20% restocking fee and the shipping charges to and from our warehouse will be applied to candy received back at our warehouse due to undeliverable addresses or customer refusal of packages.Remember we don't accept returns on candies.
Cancellations:
If the customer decide to cancel the order before is shipped, the refund will be the total of the order less 2.5%. If the Payment is made it with a credit card.
Incorrect Shipping Address:
If the customer provides the wrong address when placing an order, the following shall apply:
- If the order is returned to Mexican Candy Online in good condition: Customer will be responsible for the full cost of shipping as well as a ten percent (10%) restocking fee.
- If the package is returned to Mexican Candy Online but the contents are damaged or if the package is lost: No refunds.
Incorrectly Ordered Items:
In order for credit to be received for incorrectly ordered items, the product must be returned, at purchaser’s expense, to our return address listed above, and must be in the same condition as it was received.
All returns caused by customer error may be subject to a twenty (20) percent restocking fee.
Merchandise must be returned, at purchaser's expense, in the same condition as it was received and it is up to the purchaser to choose a return delivery method that best suits their needs.
Please note that on orders caused by customer error, we are unable to issue credit for shipping in either direction.
Legal Statement
The data (information) that you provide during this transaction will only be used for the purpose of recording your payment. We shall abide by the principles of the Data Protection Act 1998 and ensure that the data is used for no other purposes and is not disclosed to a third party i.e. other companies or individuals unless required to do so by law.
Limitation of liability
In no event will Mexican Candy Online Ca, its suppliers, or other third parties mentioned at this site be liable for any damages whatsoever (including, without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

You may terminate this Agreement at any time. Mexican Candy Online Ca also may terminate this Agreement at any time without notice, and accordingly may deny you access to the Site, if in our sole judgment you fail to comply with any term or provision of the Agreement. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.
